Terms and Conditions

1. Introduction

These Terms and Conditions (the “Terms”) govern access to and use of the website located at https://roamgo.net (the “Website”) and the eSIM connectivity products and related services (collectively, the “Services”) offered by RoamGo LLC, a limited liability company organized under the laws of the State of Delaware, with its registered address at 1111B S Governors Ave # 98660, Dover, DE 19904, USA (“RoamGo”, “we”, “us” or “our”).

By browsing the Website, creating an account, or purchasing, downloading, activating or otherwise using any Service, you (the “User”, “you” or “your”) acknowledge that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Website or the Services.

These Terms constitute a legally binding contract between you and RoamGo. We recommend that you print or save a copy of these Terms for your records.

2. Definitions

For the purposes of these Terms, capitalized terms shall have the meaning set forth below:

“eSIM” means an embedded SIM profile delivered digitally that enables a compatible device to access a mobile network without a physical SIM card.

“Data Plan” or “Product” means any prepaid data allowance, validity period, destination(s) and other features associated with an eSIM offered by RoamGo.

“Activation” means the moment the eSIM first registers on a mobile network, which starts the validity period of the Data Plan unless otherwise specified on the product page.

“Local Partner” means the mobile network operators and aggregators whose networks are used to deliver the Services.

“Account” means the user account created by you through the Website in order to purchase and manage Services.

3. Acceptance and Modification of the Terms

By using the Website or the Services, you represent and warrant that (i) you are at least eighteen (18) years of age or the age of legal majority in your jurisdiction; (ii) you have full capacity and authority to enter into a binding agreement; and (iii) all information you provide to RoamGo is true, accurate, current and complete.

RoamGo reserves the right to modify, update or replace these Terms at any time. The updated version will be posted on the Website with a revised “Effective date.” Material changes will, where reasonably possible, be notified by email or through a notice on the Website. Your continued use of the Services after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Services.

4. Description of the Services

RoamGo offers prepaid mobile data connectivity to international travelers through eSIM technology. The Services allow eligible devices to connect to mobile networks operated by our Local Partners in the destination(s) covered by the Data Plan purchased by the User.

The Services are intended solely for ordinary, non-commercial personal data usage while traveling. Unless expressly stated on the product page, RoamGo eSIMs are data-only and do not include traditional voice calls, SMS messaging, tethering guarantees, a dedicated phone number, or emergency calling services.

Service features, destinations, allowances, validity periods, speeds (including any reduction of speed after a fair-use threshold), and pricing are described on the applicable product page on the Website and may be updated from time to time. The information displayed on the product page at the time of purchase shall prevail.

5. User Account

To purchase certain Services you may be required to create an Account. You are responsible for providing accurate registration information, safeguarding your login credentials, and for any activity that occurs under your Account. You agree to notify RoamGo immediately of any unauthorized access to or use of your Account.

RoamGo may, at its sole discretion, suspend or terminate any Account that it reasonably believes is being used in breach of these Terms, for fraudulent purposes, or in a manner that could harm RoamGo, its Local Partners or other users.

6. Purchase Process and Payment

Orders are placed through the Website by selecting a Data Plan, providing the required information, accepting these Terms and completing payment. A purchase is deemed accepted once RoamGo confirms the order by email and delivers the eSIM activation details (including a QR code and/or manual installation instructions). Delivery is electronic only; no physical SIM card is shipped.

All prices are displayed in U.S. dollars (USD) unless otherwise indicated and are inclusive of applicable taxes where required by law. Payment is processed by third-party payment service providers using the methods listed on the checkout page. RoamGo does not store complete payment card information on its own systems.

You represent and warrant that you are the lawful holder of the payment method used, and that you have sufficient funds or credit available to complete the purchase. RoamGo reserves the right to cancel or refuse any order in the event of suspected fraud, payment failure, pricing errors, or other legitimate reasons.

7. Installation and Activation of the eSIM

Following purchase, the User will receive installation instructions by email. The User is solely responsible for correctly installing and activating the eSIM on a compatible, unlocked device in accordance with the instructions provided.

Unless otherwise indicated on the product page, the validity period of the Data Plan begins upon Activation, not at the moment of purchase or installation. A Data Plan that has not been activated within the timeframe specified on the product page may expire without further notice and without entitlement to a refund.

RoamGo does not guarantee a specific number of eSIM reinstallations. Certain devices and operating systems limit the number of times an eSIM profile can be reinstalled. Once deleted from the device, an eSIM may not be recoverable, and replacement is not guaranteed.

8. Device Compatibility

The Services can only be used on devices that (i) support eSIM technology; (ii) are unlocked for use with any mobile network operator; and (iii) are compatible with the radio frequencies used by the Local Partners in the destination of travel. The User is solely responsible for verifying device compatibility prior to purchase. A current list of generally compatible devices is available on the Website for reference only.

RoamGo shall not be responsible for service failures or performance issues arising from the use of non-compatible, locked, rooted, jailbroken or modified devices, outdated operating systems, incorrect device settings, or the disabling of data roaming.

9. Coverage, Speed and Quality of Service

Coverage, speed and availability of the Services depend on the infrastructure of the Local Partners and on factors outside RoamGo’s reasonable control, including but not limited to geographic location, weather conditions, network congestion, device capabilities, local regulations and temporary network maintenance or outages.

Advertised speeds are theoretical maximums offered by the Local Partner and do not constitute a guarantee of actual throughput. The Services may be subject to speed reductions, prioritization, or data shaping once certain usage thresholds are reached, as described on the applicable product page.

RoamGo does not warrant that the Services will be uninterrupted, error-free, secure, or that coverage will be available at every location within a stated country or region.

10. Fair and Acceptable Use

The Services are intended for legitimate, personal, non-commercial use. You agree not to use the Services:

  • In a manner that violates any applicable law, regulation, or third-party right;
  • To transmit unsolicited communications, spam, or malicious software;
  • For continuous machine-to-machine, bulk data transfer, commercial resale, peer-to-peer file distribution, or traffic-generation activities;
  • To access or attempt to access the Services from a country or region not covered by the Data Plan purchased;
  • In a manner that could overload, damage, or impair the networks of RoamGo or its Local Partners, or that is inconsistent with ordinary retail consumer roaming use.

RoamGo may, without liability, throttle, suspend or terminate Services used in breach of this section, and may refuse future sales to Users engaged in abusive or fraudulent behavior.

11. Cancellation and Refund Policy

Because the Services are digital goods delivered electronically and tied to individual activation, all sales are final once the eSIM has been installed or activated, except as expressly provided in this section or as required by applicable law.

RoamGo may grant a refund or issue a replacement eSIM where the User can reasonably demonstrate that:

  • The eSIM was never installed on a device and no data has been consumed;
  • The eSIM failed to activate due to a verified technical issue attributable to RoamGo or its Local Partners, and our technical support team was contacted and given a reasonable opportunity to troubleshoot prior to the end of the validity period; or
  • The Service was materially different from the description published on the Website at the time of purchase.

Refund requests must be submitted to our customer support team within thirty (30) days of the date of purchase, together with the order reference and any diagnostic information requested. Refunds will be processed to the original payment method and may take several business days to appear in the User’s account, depending on the payment provider.

Refunds will not be granted for, among other circumstances: (i) use of an incompatible or locked device; (ii) failure to follow the installation instructions provided; (iii) deletion of the eSIM profile by the User; (iv) data consumed prior to the refund request; (v) travel plans that were cancelled or changed by the User; or (vi) dissatisfaction with network speed in specific locations within a country where service is otherwise available.

12. Customer Support

RoamGo provides customer support through the contact channels listed on the Website. When contacting support, please include your order reference, the device model and operating system version, the destination(s) of travel, and a description of the issue, including any error messages observed. We will endeavor to respond within a reasonable time, but do not guarantee specific response times.

13. Intellectual Property

All content on the Website, including without limitation text, graphics, logos, icons, images, audio and video clips, software, trade names, trademarks and the general “look and feel”, is the property of RoamGo or its licensors and is protected by U.S. and international intellectual property laws.

Subject to your compliance with these Terms, RoamGo grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Website and Services for personal, non-commercial purposes. No other license or right, whether express or implied, is granted to you. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the Website or the Services, except to the extent such restriction is prohibited by applicable law.

14. User Content and Feedback

If you submit reviews, comments, suggestions or other materials to RoamGo (“User Content”), you grant RoamGo a worldwide, perpetual, irrevocable, royalty-free, sublicensable and transferable license to use, reproduce, modify, publish, translate, distribute and display such User Content in any media, for any lawful purpose, without any obligation of compensation or attribution. You represent that you own or have obtained all necessary rights in the User Content you submit and that it does not infringe any third-party rights.

15. Privacy and Data Protection

The collection and processing of personal data in connection with the Website and the Services are governed by our Privacy Policy, available on the Website. By using the Services, you acknowledge that you have read and understood the Privacy Policy.

Certain information relating to the use of the Services (including SIM identifiers, network connection data, and volume of data consumed) may be shared with Local Partners as strictly necessary to provide the Services and to prevent fraud and abuse.

16. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, the Website and the Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, including without limitation implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation.

To the maximum extent permitted by applicable law, in no event shall RoamGo, its officers, directors, employees, agents, affiliates or Local Partners be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including without limitation loss of profits, loss of business, loss of data, loss of opportunity or reputational harm, arising out of or in connection with your use of, or inability to use, the Website or the Services, even if RoamGo has been advised of the possibility of such damages.

Except in cases of gross negligence, willful misconduct or death or personal injury caused by RoamGo’s negligence (where such limitation is not permitted), RoamGo’s aggregate liability to you for any claim arising out of or related to these Terms or the Services shall not exceed the amount actually paid by you to RoamGo for the specific Data Plan giving rise to the claim.

17. Indemnification

You agree to defend, indemnify and hold harmless RoamGo and its officers, directors, employees, agents, affiliates and Local Partners from and against any and all claims, liabilities, damages, losses and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with (i) your access to or use of the Website or the Services; (ii) your violation of these Terms; (iii) your violation of any third-party right, including any intellectual property, privacy or other proprietary right; or (iv) any User Content you submit.

18. Force Majeure

RoamGo shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, pandemics, government action, failures of public telecommunications networks, power outages, or the acts or omissions of Local Partners.

19. Suspension and Termination

Without limiting any other remedy, RoamGo may suspend, restrict or terminate your access to the Website or the Services, with or without notice, if RoamGo reasonably determines that you have breached these Terms, engaged in fraud or unlawful conduct, or if required to do so by law or by a Local Partner. Termination will not entitle you to a refund of amounts already paid, except as expressly provided in Section 11 or required by applicable law.

Sections of these Terms that by their nature should survive termination shall survive, including, without limitation, provisions on intellectual property, disclaimers, limitation of liability, indemnification, governing law and dispute resolution.

20. Governing Law and Jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Subject to the Dispute Resolution section below, any dispute, claim or controversy arising out of or relating to these Terms, the Website or the Services shall be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, USA, and each party irrevocably consents to the personal jurisdiction and venue of those courts.

21. Dispute Resolution

Before filing any formal claim, the parties agree to attempt to resolve any dispute informally by contacting RoamGo at the email address set out in Section 24 and providing a reasonable description of the dispute. The parties shall negotiate in good faith for a period of at least thirty (30) days before initiating any legal action.

Where permitted by applicable law, you and RoamGo agree that any dispute shall be resolved on an individual basis, and you waive any right to participate in a class action, collective action, or representative proceeding.

22. Miscellaneous

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to render it enforceable, or, if such modification is not possible, severed from these Terms, and the remaining provisions shall remain in full force and effect.

RoamGo’s failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. These Terms, together with the Privacy Policy and any additional terms expressly incorporated by reference, constitute the entire agreement between you and RoamGo with respect to the Website and the Services and supersede all prior or contemporaneous communications and proposals.

You may not assign or transfer these Terms, by operation of law or otherwise, without RoamGo’s prior written consent. RoamGo may freely assign these Terms, in whole or in part, without your consent.

23. Changes to the Services

RoamGo reserves the right, at any time and from time to time, to modify, suspend, discontinue or replace any part of the Services, including but not limited to product catalogs, destinations, data allowances, validity periods and pricing, temporarily or permanently, with or without notice. RoamGo shall not be liable to you or to any third party for any modification, suspension or discontinuation of the Services.
